1.    Introduction

1.1.        This Privacy Policy is developed and approved by LLC «Dastras Tajikistan» to ensure the security and protection of personal data collected from buyers and sellers of the marketplace ‘Laklak Market’.

1.2.        This Privacy Policy is developed and approved on the basis of the Law of the Republic of Tajikistan «On Protection of Personal Data» dated 03.08.2018 No. 1537.

1.3.        This Privacy Policy is an integral part of the user agreement and agreement with sellers. By accepting (accepting the offer) or signing one of these documents, the buyer or seller expresses their unconditional consent to the processing of any data in accordance with the terms of the Privacy Policy.

2.    Basic concepts

2.1.        Personal data – information about facts, events and circumstances of the life of the personal data subject, which allows to identify his/her personality;

2.2.        Automatic processing of personal data – processing of personal data using digital technologies;

2.3.        Use of personal data – actions with personal data aimed at realising the purposes of the activities of the owner, operator and third party;

2.4.        Personal data protection – a set of measures taken to prevent unauthorised access to personal data;

2.5.        Subject of personal data – a natural person to whom the relevant personal data relate;

2.6.        Confidential information – Information received from sellers and buyers during registration and use of Laklak Market;

2.7.        Information containing commercial secret – scientific, technical, technological, financial and economic information or other information of real or possible commercial value, which, due to the fact that it is unknown to a third party, cannot freely gain access to this information on the basis of the law, and the owner of such information has a system in which the commercial secret is introduced;

2.8.        Seller – an individual entrepreneur or a legal entity registered on the Marketplace and remotely displays its goods on the Marketplace;

2.9.        Laklak Market – an information base system providing information on the status and movement of orders for goods, the order fulfilment process of the Seller and the Buyer, as well as other data and processing means used by the Parties for the exchange of information in electronic form;

2.10.    Destruction of personal data – actions as a result of which it is impossible to recover personal data;

2.11.    Depersonalisation of personal data – actions, as a result of which it becomes impossible to determine the belonging of personal data to a particular subject of personal data without using additional information;

2.12.    Cross-border transfer of personal data – transfer of personal data to the territory of foreign countries.

3.    Subject of regulation

This Privacy Policy applies to all confidential information provided by LakLak Market or other related companies. LakLak Market may receive any information from Buyers and Sellers in the course of co-operation with them and in the course of entering into and performing the terms of a contract or agreements entered into with Buyers and Sellers.

4.    By whom the information will be processed

Confidential information that that is collected, processed and stored for each buyer and seller is provided by a company, LLC «Dastras Tajikistan», registered at 84 Aini Street, Shokhmansur District, Dushanbe, Tajikistan.

5.    Which data will be processed by LakLak Market

5.1.        The confidential information that LakLak Market collects, processes and stores in relation to buyers and sellers differs depending on the situation and use of the platform.

5.2.        LakLak Market collects and processes the following categories of data where necessary:

-      Personal data;

-      Information on legal entities and their branches;

-      Information on commercial secrets;

-      Other information that may not be disclosed to third parties.

5.3.        LakLak Market collects the following data:

5.3.1.       Confidential data received from the Seller:

5.3.1.1. Required data for registration on the LakLak Marketplace:

-      First name, last name and middle name;

-      Phone number.

5.3.1.2. Data required to make changes on the LakLak Marketplace:

-      First Name;

-      Last Name;

-      Gender;

-      Year of Birth;

-      Delivery address;

-      Mobile phone number.

5.3.2.1.                Data collected from vendors:

-      List of legal entities;

-      TAXPAYER'S INFORMATION NUMBER;

-      Bank details;

-      Legal address and e-mail;

-      Name, surname and contact details of the Sellers' representatives;

-      Data on goods offered for sale on the platform.

5.3.2.  Other data that LakLak Market requires from the Seller in order to fulfil contractual obligations.

5.4.        The provisions of this Privacy Policy also apply to the cross-border transfer of confidential data. Cross-border transfer of confidential data shall be carried out taking into account the protection of the rights of the personal data subject.

5.5.        LakLak Market also implements depersonalisation of personal data.

5.6.        LakLak Market is committed to properly protecting and securing sensitive data. LakLak Market encourages buyers and sellers to visit this site regularly, as this Privacy Policy is subject to change under changes in applicable laws.

5.7.        The concept of protection and security of personal data means ensuring the protection of personal data from unlawful and unauthorised access to them, copying, modification, deletion, dissemination of personal data and other unlawful actions in relation to them.

5.8.        Personal data is provided with the consent and at the will of the buyer and the seller. Failure to provide personal data or withdrawal of consent to the processing of personal data may result in the inability to use the LakLak Marketplace.

6.    Purpose of personal data processing

6.1.        The need to process confidential data:

-      Enforcing the terms of the contract between buyers, sellers and LakLak Marketplace;

-      Provision and improvement of LakLak Market;

-      Realisation of legal rights and interests of LakLak Market Marketplace;

-      Compliance with the norms established by the legislation of the Republic of Tajikistan.

6.2.        LakLak Market processes confidential data for the following purposes:

-      To gain access to the LakLak Marketplace;

-      Providing access to individual accounts of Buyers and Sellers;

-      Processing and acceptance of orders for purchase of goods in LakLak Market;

-      Organisation of payment acceptance on LakLak Market;

-      Communicating with Buyers and Sellers, sending notifications, requests and other information about LakLak Market activities;

-      Protection of Buyers and Sellers from fraudulent actions;

-      Distributing promotional materials related to LakLak Market's activities;

-      Improving and enhancing LakLak Market's operations;

-      Protecting the rights and interests of Buyers and Sellers;

-      Collecting, processing, presenting statistics, etc.

6.3.        In the case of additional purposes or as required by applicable law, LakLak Market may require separate consent for the processing of sensitive data.

6.4.        This Privacy Policy applies to all data collected before or after the Effective Date.

7.    Procedure for collection, storage, transfer and other types of processing of confidential data

7.1.             The security of confidential data processed by LakLak Market is ensured through the implementation of legal and technical measures necessary for full compliance with the requirements of current legislation in the field of personal data protection.

7.2.             LakLak Market ensures safety and security of confidential data and takes all measures to prevent unauthorised access to confidential data by third parties. Confidential data shall be used by LakLak Market employees as necessary to fulfil the purposes specified in Part 4 of this Policy.

7.3.             Confidential data of the Buyer and the Seller will never be transferred to third parties, except for cases established by the current legislation of the Republic of Tajikistan in the field of personal data protection.

7.4.             LakLak Market may engage third parties to provide certain services in accordance with the User Agreement and Seller Agreement. If such persons have access to personal data, LakLak Market will ensure that such access is restricted to the extent necessary to provide the service.

7.5.             The period of storage of confidential data in LakLak Market is the date of achievement of the purpose for which the information was collected and processed, or is determined by compliance with the requirements of the legislation of the Republic of Tajikistan.

7.6.             All confidential data received from Buyers and Sellers shall be stored on the territory of the Republic of Tajikistan.

7.7.             The processing of confidential data shall be carried out both with the use of automatic (automated) means and without the use of automatic (automated) means.

8.    Cross-border transfer of personal data

8.1 LakLak Market has the right to carry out cross-border transfer of personal data in accordance with the terms of this privacy policy and compliance with the requirements of the legislation of the Republic of Tajikistan.

9.    Rights of the owner of confidential data

9.1.        Rights of users (buyers):

-      Make changes and additions to his/her personal data in the individual account opened in LakLak Market;

-      Can delete his/her personal data from the individual account opened in LakLak Market. Deletion of the data makes it impossible to use the LakLak Market marketplace.

-      Can make a request to LakLak Market to access his/her personal data;

-      To be aware of the existence and scope of their personal data on LakLak Market;

-      To receive information about the conditions of access to personal data at LakLak Market;

-      To withdraw your consent to the processing of your personal data, except in cases provided for by law.

-      To ask LakLak Market to temporarily stop processing your personal data if these data are incomplete, outdated, inaccurate, obtained illegally or are not necessary for the purposes of processing and storage;

-      To contact the authorised state authorities or court for protection of rights and legitimate interests in relation to personal data.

9.2.        Rights of sellers:

-      Make changes and additions to his/her personal data in the personal account opened in LakLak Market;

-      Can delete his/her personal data from the personal account opened in LakLak Market. Deletion of the data makes it impossible to use the LakLak Market.

-      Be aware of the existence and scope of their personal data on LakLak Market;

-      To receive data about the conditions of access to personal data at LakLak Market;

-      To ask LakLak Market to temporarily stop processing your personal data if such data is incomplete, outdated, inaccurate, illegally obtained or not necessary for the purposes of processing and storage;

-      To contact the authorised state authorities or the court for protection of rights and legitimate interests in relation to personal data.

10.Final provisions

10.1.         The relations between the Buyer and the Seller arising in connection with the application of this Policy, as well as issues not regulated by the terms of this Policy, shall be governed by the current legislation of the Republic of Tajikistan.

10.2.         The User may obtain information on matters related to the processing of their personal data from the LakLak Market contact centre.

10.3.         In case of detection of unlawful use of confidential data, the data subject whose data has been used unlawfully may apply in writing to LakLak Market. The application must contain information about the identity document of the subject of confidential data, the content of the confidential data used illegally, a description of where and under what circumstances the confidential data is used illegally.

10.4.         LakLak Market reserves the right to amend this Policy without the consent of Buyers and Sellers.

10.5.         Any changes made by LakLak Market are reflected in this document. This policy is in effect indefinitely until it is superseded by a new version.
